3Flecha is not responsible for the independent operation, availability, security, accuracy, or policies of third-party services that we do not control.

9. AI-Enabled Features

3Flecha may develop, integrate, demonstrate, or provide access to AI-powered functionality.

AI technologies can produce inaccurate, incomplete, biased, outdated, or inappropriate results. AI output should not automatically be treated as factual, professional, legal, financial, medical, or other expert advice.

You are responsible for reviewing and validating AI-generated information before relying upon it for consequential decisions.

Where AI services are supplied by third parties, their own terms and policies may also apply.

10. No Professional Advice

Nothing on the Website constitutes legal, financial, accounting, medical, healthcare, investment, tax, or other professional advice.

The Website is intended to provide information about 3Flecha and its technology services. You should obtain appropriate professional advice for decisions requiring specialized professional judgment.

11. Project Discussions and Inquiries

Submitting a contact form, sending an email, or contacting 3Flecha through the Website does not automatically create a client relationship, contractual relationship, partnership, joint venture, or other formal business relationship.

A professional services relationship is created only through an applicable written agreement or other legally binding arrangement.

Information submitted through the Website may be reviewed by 3Flecha for purposes of responding to your inquiry and evaluating potential projects.

12. Quotes, Proposals, and Estimates

Any pricing, timing, scope, capabilities, project descriptions, or estimates communicated through the Website are informational unless expressly incorporated into a written agreement.

A proposal, estimate, statement of work, or other project document may contain additional terms and conditions.

Where applicable, the written agreement between 3Flecha and its client controls the actual scope, pricing, schedule, deliverables, responsibilities, warranties, and other project terms.

13. Website Availability

We may modify, suspend, restrict, or discontinue any part of the Website at any time. We do not guarantee that the Website will:

  • Always be available;
  • Operate without interruption;
  • Be free from errors;
  • Be free from harmful components;
  • Remain unchanged;
  • Be compatible with every device or browser; or
  • Meet every user's particular requirements.

Maintenance, updates, security events, hosting issues, third-party outages, and circumstances beyond our reasonable control may affect Website availability.

14. Security

We use reasonable measures intended to protect the Website and our systems. However, no website, software application, Internet connection, or electronic storage system is completely secure.

You acknowledge that use of the Internet involves inherent risks. You agree not to attempt to bypass or compromise security measures protecting the Website or any connected system.

16. User Submissions

If you voluntarily submit information, ideas, comments, suggestions, or other materials to 3Flecha, you represent that you have the right to provide that material.

You should not submit confidential information through a general Website form unless 3Flecha has expressly provided an appropriate secure mechanism for doing so.

Nothing in this section overrides confidentiality or intellectual-property obligations established by a separate written agreement.

17. Confidential Information

The Website is not intended to serve as a secure channel for transmitting confidential business information.

If you are discussing a potential project with 3Flecha and need to exchange confidential information, the parties may enter into an appropriate confidentiality or nondisclosure agreement. Confidentiality obligations relating to an actual client engagement will be governed by the applicable written agreement.

18. Privacy

Your use of the Website is also subject to our Privacy Policy, which explains how 3Flecha collects and handles personal information.

The Privacy Policy is incorporated into these Terms by reference.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

3FLECHA DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, TO THE EXTENT PERMITTED BY LAW, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • TITLE;
  • NON-INFRINGEMENT;
  • ACCURACY;
  • AVAILABILITY; AND
  • UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that information on the Website will always be accurate, complete, current, or suitable for a particular purpose. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3FLECHA LLC AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3FLECHA'S TOTAL LIABILITY ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE WILL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID TO 3FLECHA FOR USE OF THE WEBSITE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR ONE HUNDRED U.S. DOLLARS (US $100).

This limitation applies to the maximum extent permitted by applicable law and does not limit liability that cannot legally be limited or excluded. For paid professional services, the applicable client agreement may contain different liability provisions.

21. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless 3Flecha LLC and its owners, members, officers, employees, contractors, agents, service providers, and representatives from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

  • Your violation of these Terms;
  • Your misuse of the Website;
  • Your violation of applicable law;
  • Your infringement of another person's rights; or
  • Information or materials you submit through the Website in violation of another person's rights.

This provision does not require indemnification to the extent a claim results from 3Flecha's own conduct where such indemnification is prohibited by applicable law.

22. Suspension and Termination

We may suspend or terminate your access to the Website if we reasonably believe that you have:

  • Violated these Terms;
  • Misused the Website;
  • Attempted to compromise Website security;
  • Engaged in unlawful activity; or
  • Created a risk to 3Flecha, its users, clients, or systems.

We may also modify or discontinue the Website at any time. Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.

23. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles, except to the extent applicable law requires otherwise.

The parties will seek to resolve disputes in accordance with the dispute-resolution provisions below.

24. Dispute Resolution

Before commencing formal litigation concerning a dispute arising from these Terms, the parties should first attempt in good faith to resolve the dispute informally. A party seeking to initiate a dispute should provide written notice describing:

  • The nature of the dispute;
  • The relevant facts;
  • The requested resolution; and
  • Contact information for further communication.

The parties should allow a reasonable period for good-faith discussions before initiating formal proceedings, except where emergency or injunctive relief is reasonably necessary.

Any formal dispute will be subject to the applicable laws and jurisdictional requirements of the State of Wyoming and the appropriate courts having jurisdiction.

Nothing in this section prevents either party from seeking temporary or emergency equitable relief where necessary to protect intellectual property, confidential information, systems, or other legally protected interests.

25. No Waiver

If we do not enforce a provision of these Terms immediately, that does not constitute a waiver of our right to enforce that provision later. A waiver must be made in writing to be effective.

26. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

27. Entire Agreement

These Terms, together with the Privacy Policy and any other policies expressly incorporated into these Terms, constitute the agreement governing your use of the Website.

For clients receiving professional services from 3Flecha, a separately executed agreement, statement of work, master services agreement, order form, or other written contract may govern the professional relationship and will control where applicable.

28. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Last Updated” date.

Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law. If a change materially affects your rights or obligations, we may provide additional notice where appropriate.
